1. Acceptance of Terms & Service Scope

By registering an account on app.mxbees.com, accessing our APIs, or purchasing verification volume packs, you represent and warrant that you are authorized to agree to these Terms of Service on behalf of yourself or your corporate entity.

MXBees is owned and operated by SMART INFOTECH (Regd. Ministry of MSME, Govt. of India, Udyam: UDYAM-KR-25-0043553), Karnataka, India. If you do not agree with all terms herein, do not access or use the platform.

2. Acceptable Use & Strict Anti-Abuse Policy

MXBees provides automated RFC 5321 SMTP mailbox existence probing, MX record lookups, disposable email flagging, and catch-all analysis. You agree that MXBees shall only be used for legitimate purposes, including:

• Validating opt-in subscriber and customer databases to reduce bounce rates.
• Hygiene maintenance of B2B sales and outbound prospect records.
• Preventing bot spam on public registration and checkout forms via API.

Prohibited Activities:

• Using the service to harvest or generate randomized dictionaries of email addresses for unsolicited spam.
• Attempting to attack, reverse engineer, or exhaust mail exchange servers of third-party domains.
• Violating the Indian Information Technology Act 2000, US CAN-SPAM Act, or EU General Data Protection Regulation.

Violation of these terms will lead to immediate account termination without refund.

3. Credit Model, Pricing & Non-Expiring Balance

MXBees operates strictly on a wholesale, pay-as-you-go volume package model. We do not impose recurring monthly subscriptions or hidden renewal charges.

• No Expiration: Purchased verification credits do not expire as long as your account remains active and in good standing.
• Deduction Rules: Credits are deducted only upon execution of verification checks. Rate adjustments (such as the Night Shift discount between 8:00 PM and 5:00 AM IST) are automatically computed at execution time.
• Currency & Taxes: All standard pricing is denominated in Indian Rupees (INR). Commercial purchase receipts are issued upon payment confirmation.

4. Service Availability & Deliverability SLA

While we maintain a target uptime of 99.9% across our cluster nodes and socket dispatch workers:

• Target mail server throttling: External mail exchange servers (e.g., Outlook, Yahoo, or corporate firewalls) may intermittently throttle or defer TCP handshakes. Our worker queue automatically applies exponential backoff retries.
• Catch-all domains: By design, catch-all domains accept all inbound recipient probes. MXBees accurately flags these domains but cannot guarantee mailbox delivery when the target server deliberately suppresses delivery failures.

5. Limitation of Liability

To the fullest extent permitted by applicable Indian law, SMART INFOTECH and MXBees shall not be liable for any indirect, incidental, or consequential damages resulting from third-party SMTP server behavior, external ESP account suspensions, or loss of marketing pipeline. Our maximum cumulative liability for any dispute shall not exceed the amount paid by you in the preceding 30 days.

6. Governing Law & Jurisdiction

These Terms of Service are governed by and construed in accordance with the laws of India. Any legal dispute, arbitration, or proceeding shall be subject to the exclusive jurisdiction of the competent courts of Karnataka, India.
